Environmental - Due Diligence

We use our skills in remediation management, defining regulatory pathways and site investigation to identify potential environmental liabilities associated with acquisitions or to manage known environmental issues involved with transactions. We work for buyers or sellers and seek to identify what, if any, recognized environmental conditions or business risks may be associated with a property due to environmental concerns. Our goal is to quantify the cost of any environmental liabilities, so the transaction may proceed with an appropriate business solution.

Our objective is to define the acceptable risk to the buyer, and implement a program that will meet these established goals. For initial investigations of real property, we follow ASTM Standard 1527 or 1528. When assessing oil and gas properties or mines and mills, we customize the ASTM Standard to address the specific environmental issues associated with extractive industries. For manufacturing or processing facilities, we can often rely on previous regulatory investigations to guide our program.

Environmental Site Assessments

In any given year, we do several Phase I Environmental Site Assessments in New Mexico, Colorado, Texas, and California. Depending on the location, site characteristics, and the client’s schedule, we can complete a Phase I in less than 2 weeks. We give special attention to the past uses of properties with historic backgrounds to insure that nothing significant is missed in our investigation. In instances where a Phase II or ground water monitoring is necessary, we are experienced and capable with these procedures as well.

Large Environmental Site Assessment and Management Projects

Our work at the ICON site in San Diego is an excellent example of our familiarity with lending environmental assistance in large development projects. Our staff has taken a key role in coordinating work between construction and environmental workers, local regulators, and the site owner for the re-development of a historic building in downtown San Diego. We have been integrally involved in the planning and facilitation of underground storage tank removals, regulatory compliance, and proper handling of impacted water and soil.
