For some properties, planned redevelopment and the needs of investors demand closure of regulatory files. At other sites, owners are willing to implement decades of monitoring, providing annual costs are low.
We have experience with a range of regulatory strategies, from seeking regulatory site closure through selective excavation and risk assessment, moving regulatory authority from RCRA to state programs to significantly reduce permit fees, to implementing several years of annual monitoring followed by an appeal to the authorities for a risk-based closure. We look for the best ways to achieve regulatory compliance or needed environmental permits given each site’s specific characteristics, history, and potential remediation costs.
In Southeastern New Mexico, near Loco Hills we have worked with a client and the regulatory agencies concerned to examine the site characteristics and determine if a clay lined pit for brine storage may be sufficient to protect human health and the environment and allow for the money saved on a synthetically lined pit to go towards other remediation goals.
In Portales, we have been employed to manage changes at a dairy product processing plant to achieve regulatory compliance for discharges by developing an effluent management plan.
